Welcome to the eBenefits Tracker website at ebenefitstracker.com (the “Website”). We hope you find the Website and the services and features it provides informative and useful.

As a condition of, and in consideration for, your access to and use of the Website and its services and features, you (also referred to in these Terms of Service as “you”, “your” and “user”) agree to be bound by these Terms of Service (the “TOS”) and by the eBenefits Tracker Privacy Policy, which is fully incorporated into these TOS. These TOS are a legally binding agreement between you and eBenefits Tracker (“eBenefits Tracker”, “we”, “us” or “our”). Any use of or access to the Website or its services means that you accept and agree to be bound by these TOS.

02What we do, and what we do not do

eBenefits Tracker is an independent, privately owned information service. We send plain-language guides by email about public-benefit programs, such as food assistance, energy and utility bill help, rent and housing help, health coverage, childcare, phone and internet discounts, and senior and veteran programs. We also send deadline and renewal reminders and program-update alerts by email and, if you opt in, by text message. Our goal is to help you keep track of programs you may want to look into.

• We are not a government agency. We are not affiliated with, endorsed by, or connected to any government agency or any official benefit program, and nothing on the Website should be read as official program information or as a statement made on behalf of any agency.
• We do not determine eligibility. Only the agency or organization that runs a program can decide who qualifies, for how much, and for how long.
• We do not take, review, submit, or process applications, and we never ask you to pay us to apply for a benefit. When you are ready to apply, you apply directly with the official program.
• All products and services provided by eBenefits Tracker are for educational and informational purposes only. Nothing on the Website or in our messages is legal, tax, financial, or benefits advice.

There is no guarantee that you will receive any benefit by using the guides, reminders, and alerts we provide. Program rules, amounts, dates, and availability differ from place to place and change over time, and we do not guarantee that any guide, date, reminder, or alert is complete, current, or free of errors, or that it will reach you in time. We do not guarantee any approval, amount, or outcome. Always confirm details with the official program before you act. Any examples we use are illustrations only and are not intended to represent or guarantee that you will achieve the same results.

03Changes to the service and these terms

eBenefits Tracker reserves the right to modify, alter, or discontinue, temporarily or permanently, any service or any part of a service, with or without prior notice, at any time and in its sole discretion. eBenefits Tracker will not be liable to any user for any such alteration, modification, suspension, or discontinuance of the services or any part of them.

We may also change these TOS. Your continued use of the Website or its services after a change to these TOS is posted means you accept the change, so please review these TOS regularly to stay aware of the terms currently in effect. The “Last updated” date at the top of this page shows when they were last revised. If you do not agree to a change, you must stop using the Website and its services.

04Privacy Policy

eBenefits Tracker respects your privacy. By using the Website and the services and features it provides, you understand and consent to the collection, use, and handling of your personally identifiable information and non-personally identifiable information as described in more detail in the eBenefits Tracker Privacy Policy at https://ebenefitstracker.com/privacy.html. We do not rent or share your personal information. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes, and text-messaging originator opt-in data and consent will not be shared with any third parties.

05Email alerts

If you sign up on our Get alerts page, we send reminders, guide updates, and program-update alerts to the email address you provide, for the program areas you choose. Email alerts are free. Every email includes an unsubscribe link, and you can stop our emails at any time by using it or by contacting us as described in the “Contact us” section below.

06Text messaging program

No Sharing, Selling, or Renting of Personal Information

eBenefits Tracker respects your privacy and is committed to protecting your personal information. We do not sell, rent, trade, or share your personal information with third parties for their marketing or promotional purposes.

SMS Consent and Mobile Information: No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging opt-in data and consent will not be shared, sold, rented, or disclosed to any third parties or affiliates for their own marketing purposes.

We may disclose information to trusted service providers solely as necessary to operate our services, deliver requested communications, or comply with applicable legal requirements. These providers are required to protect your information and are prohibited from using it for independent marketing purposes.

Text messages are optional. Our sign-up form has two separate text-message consent boxes, and neither box is required to sign up. You only need to give a mobile phone number if you tick at least one of them. If you choose to join our text-message program by checking one or both boxes, the following terms apply:

• Who sends the texts. All of our text messages are sent under the name eBenefits Tracker.
• What you agree to. By checking the first box, you give your express consent to receive recurring automated service updates and account notifications texts from eBenefits Tracker at the phone number you provide.
• Marketing texts need their own box. The second box is optional and separate from the first. By checking it, you consent to receive marketing communications and promotions to the phone number you provide. We send marketing and promotional texts only to people who check that second box.
• Rates and frequency. Message and data rates may apply. Message frequency varies.
• Opting out. You can opt out at any time by replying STOP to any message. After you reply STOP, you will receive no further texts from eBenefits Tracker unless you opt in again.
• Help. For more information, reply HELP to any message, use our contact form, or email info@ebenefitstracker.com.
• Consent is not required to sign up or buy. You do not have to check either box to sign up for our email alerts, and consent to receive text messages is not a condition of purchasing any products or services.
• Your number is not shared. Your mobile number will not be shared with third parties or affiliates. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes, and text-messaging originator opt-in data and consent will not be shared with any third parties.
• Carriers. Mobile carriers are not liable for delayed or undelivered messages.

07Minors

Persons under 18 years of age (or the applicable age of majority, if greater than 18) are not permitted to use the Website. eBenefits Tracker does not knowingly solicit or collect information from persons under 18 years of age. By using the Website, you affirm that you are 18 years of age or older and are fully able and competent to enter into these TOS.

08Use of the Website

eBenefits Tracker authorizes you to view or download the files, documents, text, photographs, images, audio, video, and any other materials accessed through or made available for use or download through the Website (collectively, “Content”) solely for your personal, noncommercial use. You may not copy, distribute, modify, create derivative works of, reproduce, publish, or use, in whole or in part, any Content for any commercial or other purpose except as explicitly authorized by these TOS. You may not use any computerized or automatic mechanism, including without limitation any web scraper, offline reader, spider, or robot, to access, extract, or download any Content from the Website unless eBenefits Tracker has expressly authorized you to do so.

09User conduct

You agree to access and use the Website and its services only for lawful purposes. You are solely responsible for knowing and following all laws, statutes, rules, and regulations that apply to (i) your use of the Website and its services, (ii) your use of any networks or other services connected to the Website, and (iii) any means by which you connect to the Website and its services. You are solely responsible for the substance of everything you submit through the Website. You agree not to:

1. restrict or inhibit any other user from using and enjoying the Website or its services;
2. send or transmit any unlawful, threatening, abusive, libelous, defamatory, obscene, vulgar, pornographic, or indecent information of any kind, including without limitation any transmission that constitutes or encourages conduct that would be a criminal offense, give rise to civil liability, or otherwise violate any local, state, national, or international law;
3. send or transmit any information or other material that violates or infringes the rights of others, including material that invades privacy or publicity rights, or that is protected by copyright, trademark, or other proprietary rights, or derivative works of such material, without first obtaining permission from the owner or holder of those rights;
4. send or transmit any information or other material that contains a virus or other harmful component;
5. claim a relationship with, or speak on behalf of, any business, association, institution, government agency, or other organization that you are not authorized to represent;
6. copy or collect any Content by robots, spiders, scripts, scrapers, crawlers, or any automated or manual equivalent;
7. copy, adapt, create derivative works of, decompile, reverse engineer, translate, localize, port, or modify any application programming interface, website code, or software used to provide the Website or its services; or
8. use the Website or its services in any manner or for any purpose that infringes, misappropriates, or otherwise violates any intellectual property right or other right of any person, or that violates any applicable law.

Right to regulate

eBenefits Tracker retains the right to regulate access to and use of the Website and its services in its sole discretion. You agree not to bypass any such regulation. You further agree that eBenefits Tracker is not liable for regulating or not regulating, and that no action or inaction by eBenefits Tracker is a waiver of any right to regulate.

10Proprietary rights

You acknowledge, understand, and agree that all eBenefits Tracker trademarks, copyrights, trade names, service marks, logos, and other brand features and names are, and shall remain, the sole property of eBenefits Tracker. You agree not to display or use the eBenefits Tracker logo or marks in any manner.

11Official programs and third-party links

Our guides and messages may link to official program pages, agency offices, and other websites that are operated by third parties. eBenefits Tracker does not control and is not responsible for third-party content, terms, policies, decisions, or practices. Any application you submit, and any arrangement you make with a program, agency, or other third party, is solely between you and that third party.

12Disclaimer and limitation of liability

To the full extent permitted by law, eBenefits Tracker and its officers, directors, employees, agents, licensors, and successors in interest (collectively, “eBenefits Tracker”):

1. make no promises, warranties, or representations about the Website or its services, including their completeness, accuracy, availability, timeliness, propriety, security, or reliability;
2. provide the Website and its services on an “AS IS” and “AS AVAILABLE” basis, and any risk of using the Website or its services is assumed by you;
3. disclaim all warranties, express or implied, including as to accuracy, merchantability, fitness for a particular purpose, and non-infringement, and all warranties arising from a course of dealing, usage, or trade practice; and
4. disclaim any liability or responsibility for the acts, omissions, or conduct of any user in connection with the Website or its services.

eBenefits Tracker shall NOT be liable for any direct, indirect, consequential, incidental, special, punitive, or other losses, including lost profits, revenues, data, or goodwill, or any benefit, payment, or deadline that is missed, delayed, reduced, or denied, arising from or related to the Website or its services, and in no event shall such liability exceed $100. Some jurisdictions restrict or alter these disclaimers and limits, so some of them may not apply to you.

13Choice of law and forum

These TOS are governed by the laws of the United States and the State of Iowa, without regard to conflict of law provisions. You agree that any cause of action that may arise under these TOS shall be commenced and heard in the appropriate court in Linn County, in the State of Iowa, and you agree to submit to the personal and exclusive jurisdiction of the courts located in Linn County, in the State of Iowa. You agree to waive all rights to trial by jury. Regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to the use of the Website or its services must be filed within two (2) years of the date on which it arose, or the date on which it could reasonably have been discovered, or it shall be forever barred.
